  • Two months after the Pac-12 took the Mountain West to court over the legality of a penalty in the conferences' scheduling agreement, the defendant fired back.

The Mountain West Conference has filed a motion to dismiss a lawsuit brought by the Pac-12 Conference, which seeks to enforce a $55 million exit fee from San Diego State University (SDSU) for its intent to leave the Mountain West for the Pac-12. The Pac-12 alleges that SDSU breached its contract by notifying the Mountain West of its departure after the deadline, thus triggering the hefty exit fee. However, the Mountain West argues that SDSU's notice was timely and that the Pac-12's lawsuit is premature since SDSU has not officially withdrawn from the Mountain West. The Mountain West also contends that the Pac-12 lacks standing to sue over the exit fee, as it is not a party to the agreement between SDSU and the Mountain West. This legal battle comes amidst broader conference realignment in college sports, with SDSU's move being part of a larger shift influenced by media rights deals and competitive positioning.
